Terms of Use

1. Agreement to Terms

These Terms of Service (the "Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and BLU Seven Limited, doing business as BLUSVN ("BLUSVN," "we," "us," or "our"), concerning your access to and use of the BLUSVN.com website and any related media form, media channel, mobile website, or mobile application (collectively, the "Site").

BLUSVN™ Technologies is a vertical marketplace platform that provides a range of services, including but not limited to, web and mobile-based applications that connect users with independent third-party providers, such as drivers for logistics or delivery services ("Third Party Providers"). These services, including payment processing and customer support, are referred to as the "Services."

By accessing the Site or using the Services, you agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND SERVICES, AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. User Representations and Restrictions

By using the Site, you represent and warrant that: (a) you are at least 18 years of age or have the permission of a parent or guardian if you are between 13 and 18; (b) you will not use the Site for any illegal or unauthorized purpose; (c) your use of the Site will not violate any applicable law or regulation; and (d) you will not access or use the Site for any purpose other than for personal, non-commercial use, unless otherwise agreed to in a separate written agreement with BLUSVN.

You agree not to use the Site to:

  • Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • Publish, post, upload, distribute, or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful material or information.
  • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
  • Use any automated system, including "bots," "spiders," or "offline readers," to access the Site in a manner that sends more request messages to our servers than a human can reasonably produce in the same period.

3. User Account and Security

You may be required to register with the Site. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with these security obligations. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

4. Intellectual Property Rights

Unless otherwise indicated, the Site and all content and other materials on the Site, including, without limitation, the BLUSVN™ and BLU Seven Limited logos, and all designs, text, graphics, pictures, information, data, software, sound files, other files, and the selection and arrangement thereof, are the proprietary property of BLUSVN or our licensors and are protected by U.S. and international copyright laws.

You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Site and Services for your personal, non-commercial use only. This license is subject to these Terms and does not include: (a) any resale or commercial use of the Site or the materials; (b) the distribution, public performance, or public display of any materials; (c) modifying or otherwise making any derivative uses of the Site and the materials, or any portion thereof; (d) any use of data mining, robots, or similar data gathering or extraction methods; (e) downloading (other than page caching) of any portion of the Site, the materials, or any information contained therein, except as expressly permitted on the Site; or (f) any use of the Site or the materials other than for their intended purposes.

5. Refund and Cancellation Policy

This policy outlines the conditions for all refunds and cancellations of orders placed through the Site.

5.1 Full Refunds

A full refund is provided for orders that are canceled prior to reaching the "Accepted" status. To qualify for a full refund, the cancellation must be initiated by the customer through the designated "Manage Orders" section on the official BLUSVN mobile application or website.

5.2 Partial Refunds

A partial refund may be issued for orders that are canceled after they have entered the "Accepted" status but before they are "On The Way." The refunded amount will be the total order cost minus any applicable fees, including, but not limited to, delivery, regulatory, and payment processing fees. The precise refund amount will be displayed to the customer in real-time prior to the cancellation being confirmed.

5.3 Non-Refundable Situations

Refunds and cancellation options are no longer available once an order has progressed to the "On The Way" status. No exceptions to this policy will be granted. The initial payment processing fee is non-refundable regardless of the order status. Additionally, the premium for the "ULTRA" delivery option, if selected, is non-refundable once the order has reached "Accepted" status.

5.4 Refund Methods

All refunds for orders paid with a credit card or other standard payment methods will be disbursed to the original payment method used at the time of purchase. All refunds for orders paid with Account Credits will be credited to the customer's account immediately. The processing of refunds to a financial institution may take up to 5-7 business days. For detailed inquiries, customers should contact their financial institution.

5.5 Cancellation Process

Customers may cancel orders through the "Manage Orders" section of the official BLUSVN app or website. Once a cancellation is confirmed, it cannot be reversed. Important: Orders cannot be canceled once they have reached the "On The Way" status.

Steps to Cancel:

  • Log in to your account.
  • Go to the "Manage Orders" tab.
  • Select the order you want to cancel.
  • If available, click the "Cancel Order" button and follow the on-screen instructions.

6. Third-Party Websites and Content

The Site may contain links to other websites ("Third-Party Websites") as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties ("Third-Party Content"). We are not responsible for any Third-Party Websites or Third-Party Content accessed through or posted on the Site. The inclusion of any link does not imply endorsement by BLUSVN of the site or any association with its operators.

7. Disclaimers and Limitation of Liability

7.1 Disclaimers.

THE SITE AND SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOUR USE OF THE SITE AND OUR SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE'S CONTENT OR THE CONTENT OF ANY WEBSITES LINKED TO THE SITE.

7.2 Limitation of Liability.

IN NO EVENT WILL BLUSVN OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES. THIS LIMITATION APPLIES EVEN IF BLUSVN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.3 ULTRA Delivery.

By placing an ULTRA order with BLUSVN, you agree to the following terms and conditions regarding your delivery:

  • Non-Refundable Fee: The ULTRA premium $1 charge is non-refundable.
  • Delivery Process: An adult must be present at the delivery address to receive the order. BLUPal will make every effort to deliver your order to the address and indoor delivery area you selected.
  • A PIN, found inside of your order, is required to be given to the BLUPal to complete the delivery and serve as proof of delivery.
  • Failed ULTRA Delivery: If an adult is not present, the ULTRA delivery cannot be completed, and your order will immediately be reverted to a BLU delivery type and left at your doorway or nearby area accompanied by a proof of photo.
  • Assumption of Responsibility: Once BLUPal has delivered your order and the PIN has been confirmed, BLUSVN is no longer responsible for the value-pack size bottled water case(s). This means we are not liable for any loss, theft, damage, or tampering that occurs after the delivery has been completed.
  • Order Accuracy: We take great care to ensure your order is accurate and in good condition upon delivery. It is your responsibility to inspect your order upon receipt. If you find any issues with the contents or condition of your order, you must contact BLUSVN Support immediately with your order number and a clear description of the problem.

8. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (a) your use of the Site; (b) your breach of these Terms; (c) your violation of the rights of a third party, including but not limited to intellectual property rights; or (d) any overt harmful act toward any other user of the Site.

9. Governing Law and Dispute Resolution

9.1 Governing Law.

These Terms and your use of the Site and Services are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

9.2 Dispute Resolution.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware. The parties agree that any and all disputes arising out of or in connection with these Terms, or any services provided by BLUSVN, shall be resolved by final and binding arbitration in accordance with the Federal Arbitration Act. The arbitration shall be conducted by a single arbitrator administered by the American Arbitration Association (AAA).

9.3 Class Action Waiver.

THE PARTIES AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED IN THEIR INDIVIDUAL CAPACITIES ONLY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION, AND THE PARTIES EXPRESSLY WAIVE THEIR RIGHT TO FILE A CLASS ACTION OR SEEK RELIEF ON A CLASS BASIS. YOU AND BLUSVN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10. Miscellaneous

These Terms constitute the entire agreement between you and us regarding the use of the Site. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
